The "Mechanical Permit" & "Repairs" Loophole

What Eagan Found

Eagan's interim ordinance included this language:

"No mechanical permit shall be issued for the installation or replacement of cooling, standby power, or fuel storage equipment, other than repairs necessary to maintain existing, lawfully permitted operations at their nameplate rated capacity."

The problem Eagan discovered: An applicant claimed chiller replacements were "routine maintenance" (repairs) rather than expansions. By replacing chillers with higher-capacity units, they could add load without new permits.

How This Could Apply to Woodbury

Scenario 1 (401 Bielenberg): Facility is permitted at 15 MW. To expand to 66 MW, operators claim "chiller replacement" is maintenance, not expansion. New chillers with 66 MW rating replace 15 MW originals. Under vague "repairs" exemption, no new mechanical permit required.

Scenario 2 (500 Bielenberg): Facility is permitted at 6 MW. To expand to 34 MW, claim "generator upgrade" is maintenance. Install higher-capacity generators. No new permit required under "repairs" exemption.

Eagan's Solution: City required permits to specify "nameplate rated capacity." Any equipment replacement must maintain that capacity, not exceed it. Expansion requires new permits.

Finding: Without explicit "nameplate capacity" language in mechanical permits, Woodbury faces the same loophole Eagan found. Expansion could proceed as "repairs" without new permit review.

Eagan's Permit Denial: The Unpermitted Chillers Issue

Eagan's Finding: "The applicant operated chillers without a mechanical permit or interim use permit approval."

Four temporary and eight permanent chillers were operating before approval. This became a grounds for permit denial.
